Louisiana takes driving under the influence (DUI) cases very seriously, especially in the case of multiple offenses. Third and fourth DUI convictions are felonies, subject to substantial fines and jail time. If you get a fourth DUI or DWI conviction, you face a thirty-year prison sentence.

Louisiana has a ten-year cleansing period for past DUI convictions. Those convictions can be quashed if the judge did something that thwarted your rights, such as failing to inform you of the minimum and maximum penalties in court.

We carefully evaluate every aspect of your DUI case and look for deficiencies in the prosecution's case. For example, if you refused a breathalyzer test (which we advise our clients to do if they call us during the arrest), it can be difficult for the state to prove a DUI case, especially if you are able to pass the field sobriety test.

If you take the breathalyzer test and the result is .08 or higher, you are presumed to be intoxicated in Louisiana. However, an experienced lawyer may still be able to overcome that presumption in one of the following ways:

  • By examining the intoxilyzer or breathalyzer machine and determining whether it was calibrated correctly.
  • By making sure the stop was legal. If the officer did not have probable cause to pull you over, all evidence gathered after the stop can be suppressed, including breath test results.
  • By checking to see if the arrest report contained inaccuracies that would question the credibility of the arresting officer.
  • By making sure the officer was not on an incentive plan that paid a bonus at the end of the year for DUI arrests or convictions.
